1. Acceptance of Terms

By accessing or using NearMePicks.com (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you disagree, please do not use the Site.

2. Services Provided

NearMePicks provides local business listings, recommendations, reviews, and advertising placement services (collectively "Services"). We may also offer blog content, email newsletters, and promotional features.

3. Account Registration

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information, and keep it up to date. You're responsible for maintaining the confidentiality of your login and account, and for all activities under your account.

4. Advertising Terms & Client Responsibilities

4.1. Ad Review & Approval

You are responsible for reviewing and approving all ad creatives, copy, targeting, and deployment settings before going to print.

4.2. Post-Approval Liability

Once an ad is approved by you, including creatives, copy, and targeting, you assume full responsibility for its content and accuracy. NearMePicks is not liable for any issues resulting from an approved ad.

4.3. Our Commitment

If NearMePicks makes an error in ad design, formatting, or placement—even after your approval—we will make it right at no additional cost.

5. Payments

5.1. Payment Platform & Methods

All payments are securely processed via Stripe. We accept major credit cards, ACH transfers, and other payment methods supported by Stripe.

5.2. Payment Links

You will receive a payment link via email or other communication from NearMePicks.

5.3. Payment Terms

Full payment is due upfront before your ad can be included in any print cycle. Ads will not be scheduled for printing until payment is received in full.

5.4. Ad Deadline Flexibility

You can change your mind and cancel your ad before it is printed. If you cancel before the print deadline, you may be eligible for a full or partial refund, depending on the stage of production your ad is in.

5.5. Late or Non-Payment

Failure to pay on time may result in cancellation of your ad and forfeiture of placement in that print cycle.

6. Refunds & Disputes

6.1. Refund Eligibility

Refunds may be granted if:

• The ad was canceled before going to print.
• NearMePicks fails to deliver services as promised; or
• A verified error on our part causes non-delivery or misplacement.

6.2. Refund Process

• Submit your refund request, along with supporting documentation, via email.
• We will respond within 5 business days.
• Approved refunds will be processed within 15 business days.

6.3. Dispute Resolution

• Notify us of disputes within 30 days of the charge or issue.
• Parties agree to non-binding mediation before legal action.
• Claims must be brought within 1 year of the issue.

7. Intellectual Property

All content on the Site—design, text, graphics, logos, software—is the property of NearMePicks or its licensors. You may not use our trademarks, copy content, or modify any portion of the Site without written permission.

8. User Content

You retain ownership of content you post (reviews, photos) but grant NearMePicks a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and display it.

9. Prohibited Uses

You agree not to:

• Violate laws or regulations.
• Infringe on others' rights.
• Upload harmful or malicious content.
• Engage in fraud or misleading practices.

10. Disclaimers & Limitation of Liability

10.1. No Warranty

The Site and Services are provided "as-is" without warranties of any kind.

10.2. Limitation of Liability

NearMePicks is not liable for indirect or consequential damages. Total liability is limited to the amount paid by you in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless NearMePicks and its affiliates from any claims or damages arising from your use of the Site or Services.

12. Termination

We reserve the right to suspend or terminate access at any time. You may also terminate by ceasing to use our services and notifying us. Relevant sections will survive termination.

13. Governing Law

The laws of the State of California govern these Terms and Conditions. Disputes will be resolved in courts located in Orange County, CA.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be posted on this page. Continued use after updates constitutes acceptance.
